商标权质押融资价值评估难问题的分析及其对策

价值评估是商标权质押融资中不可缺少的重要环节。商标权权属的不稳定性和不确性,造成了商标权内在价值定量与固化的困难,商标权价值蕴含和体现着企业的整体价值,使之在量化中难以与企业经营价值相区分,其价值评估不同于专利权、著作权,但目前缺少专门的评估操作规则。解决商标权价值评估困难,有必要重构知识产权价值原理的基础理论,完善知识产权价值评估法律制度和商标权价值实现的交易环节等。

The Value Assessment is an indispensable important stage in the financing of trademark right pledge. The instabilities and uncertainties of the ownership of trademark right lead to the difficulties of estimating and fixing the intrinsic value of trademark right. The value of trademark right contains and reflects the whole value of the enterprise. Accordingly, it is difficult to distinguish the value of trademark right from the operation value of the enterprise in quantification. The assessment of the value of trademark right is different from that of patent right and copyright. But at present there are no specialized operation principles in the assessment of trademark right. In order to deal with the difficulties in value assessment of trademark right, it is necessary to take the flowing measures： reconstructing the basic theories of value principles of intellectual property right, improving the legal systems of the value assessment of trademark right and perfecting the market trading process for realization of the value of trademark right.
