An Economic Analysis on American Anti-monopoly Law

反垄断法是法律与经济的融合。美国反垄断法自诞生以来,其理论和实践一直受到法律及经济学理论发展的影响。文章对美国反垄断法规制的垄断行为、固定价格、价格歧视,企业合并等违法行为及其实施趋向进行了深入地分析,指出经济效率是美国反垄断法的首要价值目标,反垄断法的实施日益关注新经济条件下的创新问题。

Anti-monopoly Law is a combination of law and economy.Since its birth,its theory and practice has been influenced by the development of law and economics theory.This paper analyzes its implementing tendency and some illegal activities stipulated by it,such as monopoly,fixed price,price discrimination,merging of enterprises and so on,points that economic efficiency is the primary value goal of the law,and the implementation of the law pays attention to creativity problems under new economic conditions increasingly.
