摘要
相同或近似的商标有不同的主体享有专有权或使用权,这些共存现象有其存在的合法根据,但也会给消费者利益、市场竞争秩序造成损害,给各种反竞争性问题埋下隐患,为此应对相同与近似商标的共存现象进行分析,以对其引发的问题进行法律规制。
The same or approximate trademark has different body enjoying exclusive right or right of use,these coexisting phenomenon have legitimate reason of existent,and in the same time,it causes damage to the competition order of market and interests of consumer,and plants hidden danger to all kinds of anti-competitive problem.So we should analyze coexisting phenomenon of the same or approximate trademark.We should implement legal regulation to problems.
