试论植物育种者权利的立体保护及实例分析

On the Tridimensional Protection Mode and Case Analysis on Plant Breeder's Rights

摘要 文章从植物育种者权利的三种主要载体一植物新品种、育种方法和产品入手,论述了植物育种者权利保护的三种形式即植物品种权、专利和育种技术,提出了育种者权利的立体保护模式。以河北省农林科学院“利用甜椒核雄性不育两用系培育出了系列甜椒杂交种”为实例,对这种立体保护模式进行了进一步分析。 In this paper, three main carriers of plant breeder's rights: plant varieties, breeding technology and products were discussed. Base on the analysis on three forms of plant breeder's rights protection as the right of new plant variety and patent law and breeding technology, the author proposed the tridimensional protection mode of plant breeder's rights protection. Taking 'the hybrid strains series of genetic male sterile pepper' as an case, the tridimensional protection mode was further analyzed.
