环境法法律方法论——一个前提性的研究

Legal Methodology of Environmental Laws——A Prerequisite Study

随着法律方法论研究的逐步兴起,学者们不再局限于对法律方法论的基础理论的研究,对部门法方法论的研究也开始慢慢兴起。但对于环境法方法论的研究却还未见诸于纸端,正是基于这样的背景,文章站在司法立场上,试图建立一个面向实践的环境法方法论体系。首先要解决的问题就是明确环境法方法论的基本立场和目的,进而对环境法方法论的特征进行探究,最后对作为环境法基本原则的利益衡量以及作为环境法方法论的利益衡量进行探究。

With the gradual rise of studies on legal methodology,scholars no longer confine their studies to the ones over the basic theories of legal methodology and there is also an increase in the studies on the methodology of branch laws.However,a study over the methodology of environmental laws has not yet been published.It is based upon such a background that the paper attempts to establish a practice-orientated methodology system of environmental laws from the judicial viewpoint.The paper firstly deals with the clarification of the basic stand and purpose of the methodology of environmental laws,and then explores their characteristics.Finally,it probes into the benefit weight being the basic principle of environmental laws and the benefit weight being the methodology of environmental laws.
