房屋拆迁中地方政府职能定位之法律分析

Legal Analysis of the Function Orientation of Local Governments in Housing Demolition

近年来,房屋拆迁问题及我国现行房屋拆迁中地方政府的职能定位成为社会关注的焦点问题,政府职能存在越位、错位、缺位等现象。笔者就从法律的视角,分析拆迁过程中的政府与开发商、被拆迁人等各相关角色的权力、权利、利益关系,力图揭示出当前城市房屋拆迁中政府职能错位现象的症结所在与法律上的困境,提出完善我国现行房屋拆迁中政府职能定位的建议与对策。

In recent years,problems arising in housing demolition and the function orientation of local governments have become a major social concern.There has been omission,offside and misplacement,etc when local governments are exercising their functions.This article,from a legal perspective,analyzes the relevant factors of power,right and benefits among government,developers and people demolished,with an aim to disclose the crux of the problem.Suggestions and countermeasures are advanced to improve the function orientation of local governments in the existing housing demolition.
