国有控股、参股公司中的职务犯罪案件常常与一些非职务犯罪相关联。而在我国目前的法律制度下,检察机关缺乏对于相关案件的并案侦查权,影响了职务犯罪案件的侦查、起诉与审判。我们有必要分析现有刑事诉讼法律关于职务犯罪侦查的相关规定,建议赋予检察机关对于此类案件并案侦查权,确保我国检察权合法、公正的运行。

The duty crime cases in the state-owned companies and joint-stock companies are often associated with some general crime cases.Under China＇s current legal system,the lack of investigation power of merging cases affect the investigation,suing and adjudication.We should analyze relevant regulations about duty crime cases and suggest that endow procuratorial organs with the investigation power of merging cases,so as to ensure the legal and fair running of procuratorial authority
