摘要
与旧法的清算组选任制度相比,中国现行破产立法关于管理人选任制度的规定有很多突破,但选任方式不合国情,选任资格不够统一,选任时间有违法理。破产法的修订,应确立债权人会议主导型的破产管理人选任模式,引入临时破产管理人制度,建立市场化的破产管理人执业模式与资格制度。
Compared with the selection system of liquidation,the current bankruptcy law provides breakthroughs in the election system of administrators.However,there are also some problems in it such as impractical selection,inconsistent qualifications and unreasonable time.In the future,to amend the bankruptcy law,we should establish a selection mode of creditors' meeting-led insolvency administrator,introducing the system of temporary administrators and establishing a marketized practical manner and a qualification system of bankruptcy administrators.
