摘要
作为家庭内部分工的结果,通常由丈夫承载夫妻共同投资形成的人力资本,当婚姻破裂时,通常会被丈夫独占。家务劳动补偿制度、离婚经济帮助制度以及离婚损害赔偿制度等制度都无法保护妻子的合法权益,这不仅有违公平正义的传统理念,而且不利于保护婚姻专用性投资和妇女对婚姻的期待。研究表明,人力资本产权在本质上和其他财产一样,可以在未来带来收益。在离婚时,只要正确地评估并确定合理的分割比例,可以对人力资本进行分割。
As a result of the division of work within the family,the husband holdes human capital the couple jointly invested usually.When the marriage breaks down,the husband monopolize it.The labor compensation system,financial help system and the divorce damages system can not protect the legitimate rights of the wife.It is not only against the traditional concept of justice,but also is not conducive to protection of private investment in marriage and women expectations.Study shows that human capital property rights are same as other property in essence,and they can bring revenue in the future.In the divorce,human capital can be divided as long as we evaluate correctly and determine a reasonable ratio of division.
