Implications of Government by Law in Our Socialist Society With Chinese Characteristics

依法治国,建设社会主义法治国家,在追求具有普适性的法治理想和目标的同时,要坚持中国特色社会主义法治之路,已被越来越多的人认同。中国特色社会主义法治之路,就是指与世界上现存的其他法治模式不同的一种法治建构模式。所谓中国特色,就是在学习、借鉴国外先进经验的前提下,立足中国的实际,从中国国情出发。具体说来,其标志应体现在坚持中国特色社会主义理论体系的指导,坚持社会主义,不照搬西方的政治模式,正确对待中国的传统法律文化,坚持走中华民族的自主创新之路等方面。

It has been increasingly ackowledged that it is necessary to adhere to taking the socialist road to government by law with Chinese characteristics when we manage state affairs according to law and build up our socialist country by administering it in the light of law,and when we pursue our ideal and objective of realizing universal government by law.Our socialist road to government by law with Chinese characteristics is a structure model of government by law which is different from all the other models of government by law in the world.By Chinese characteristics,we mean that under the precondition that we learn and draw on the advanced experience of other countries,we base ourselves on China＇s actualities and proceed from the national situation.Specifically,the hallmarks of China＇s structure model of government by law should be reflected in the following： adhering to the guidance of the socialist theoretical system with Chinese characteristics;adhering to socialism instead of copying Western political models;correctly handling traditional Chinese legal culture;adhering to taking the Chinese nation＇s road to development by keeping the initiative in our own hands and bringing forth new ideas.
