论中国国情下党领导立法的若干基本问题

A Study on Theory and Practice of the Chinese Communist Party's Leadership in Legislation

坚持中国共产党对我国立法的领导,是中国特色社会主义法治建设题中的应有之义,也是社会主义法治理念的重要内涵。为此,需要对中国国情下党领导立法的若干基本问题作出理论深化和实践总结,以更好地坚持和完善党对立法的领导,推进依法治国。文章立足于党的领导、人民当家作主和依法治国的有机统一,从党的领导与人民当家作主,党领导立法的原则、特点和途径,构建和增进党与人民代表大会间的和谐关系,完善党对立法的领导等方面作了阐述。

Legislation in China placed under the leadership of the Communist Party of China（CPC） is an essential meaning of the topic of construction of government by law in our socialist society with Chinese characteristics,as well as an important implication of the notion of government by law under socialism.Therefore,it is necessary to make a summary of theoretical depth and practical value concerning a number of fundamental questions of legislation led by CPC in the context of the national situation,so as to better adhere to and improve the Party＇s leadership in legislation,as well as to push on administration of the state according to law.Based on the national conditions in China,this paper studies the theory and practice of the Communist Party of China＇s leadership in legislation.The paper analyzes the theme from the following aspects： an analysis of the history of the CPC＇s leadership in legislation and some typical issues,governance according to law by CPC and legislation by the People＇s Congress,the relationship between the Party Committee the People＇s Congress and improving modes of exercising the Party＇s leadership over People＇s Congress,improvement of the CPC＇s leadership in legislation.
