地质资料信息服务产业化中的泄密风险与法律对策

The Leak Risk and Legal Countermeasures in Industrialization of Geological Data Information Services

地质资料信息服务产化是以产权经营理念对现有地质资料展开现实空间与网络空间的有偿利用。由于垄断性和排他性是产权成立的基本要素,确保地质信息安全便成为决定产业化成败的关键问题。针对产业化各环节面临的泄密风险,现有法律制度在调整范围、救济程序等方面存在不足,应加强地质勘查环节的项目管理、完善汇交环节的法律规范、建立地质数据库特别保护制度以及合理限制科研教育机构对地质资料版权的法定许可权。

The industry of geological data and information means paid services in both real and cyber space based on the concept of property rights.Since monopoly and exclusive establishment are the basic elements of property rights,it comes to be a key factor in the success or failure of the industrialization to ensure the security of geological information.For the risk of leakage,there exist deficiencies in the present legal system,in the adjustment range and relief procedures to prevent the risk of disclosure.So the project management in geological exploration should be strengthened,and laws and regulations should be given to improve the links of data or information collection and transfer.And special protection systems for geological database should be established,and research and education institutions＇ statutory license for the copyright of geological data should be reasonablly restricted.
