A Rational Analysis of Chinese Traditional Judicial Viewpoints

中国传统司法观是中国传统司法文化的核心,其主要表现是:仁道司法观、中道司法观与和谐司法观。仁道司法观将仁爱之道当成一种司法价值,中道司法观将中庸之道当成一种司法价值,和谐司法观将社会和谐与自然和谐当成一种司法价值。上述司法观对抑制封建司法的非人道性起了一定的积极作用。

Chinese traditional judicial viewpoints,consisting of the elements of rendao（humanity）,zhongdao（moderateness） and hexie（harmony）,are deemed the core of the Chinese traditional judicial culture.The rendao viewpoint takes kindheartedness as a judicial value while zhongdao maintains golden mean a value and hexie values a lot of social as well as natural harmony,all of which contribute to some extent to the restraint of feudal judicial inhumanity.
