Talk about the law of the parking garage by the harmonious view

通过对我国《物权法》第74条关于小区停车位、车库归属的分析,指出《物权法》第74条中存在的问题,并提出通过设定法定停车位和自行增设停车位的方式,以缓解车库与停车位的需求日益增多所带来的一系列法律问题。从而一方面保障广大业主的合法利益,另一方面也能兼顾开发商的利益,同时缓解环境污染,加速经济增长,最终促进和谐社区与和谐社会的建设。

This paper points out the problems existing in the 74th clause of Property Law by analysis of regulation,about ownership of parking space and garage,in it,and put forward that we can alleviate the legal problems that are derived from growing needs to parking space and garage by setting legal parking space and spontaneously setting parking space.On the one hand this way will protect general owners＇ legal interests;on the other hand it also can juggle developers＇ interests and ease envirmental pollution,boosting economic growth and eventually promoting harmonious complex and the construction of a harmonious society.
