婚姻法司法解释(三)(征求意见稿)有关人身关系的规定有突破也有局限。有关婚姻登记瑕疵的处理不应驳回了事,而应明确当事人可以通过行政诉讼来解决问题。有关生育权纠纷的规定体现了保护妇女生育权的法律精神。亲子关系的确认与否定,应更好地贯彻儿童优先的原则。无民事行为能力人离婚问题的规定有利于保护无民事行为能力人的离婚权。

Provisions of ＂Marriage Law Judicial Interpretation Ⅲ（Exposure Draft）＂ relating to personal relations have limitations as well as breakthroughs.Defective marriage registration should not be simply dismissed,and measures should be taken to guarantee that parties can bring administrative proceedings to resolve the problem.Regulations of reproductive rights disputes should reflect the spirit of the law for protecting women＇s reproductive rights.With regard to parent-child relationship confirmation,the principle of the best interests for children should be adhered to.Regulations on divorce relating to people without capacity for civil acts should guarantee their right to divorce.
