摘要
农村集体建设用地使用权的流转虽然在法律上受到严格的限制,但现实中其流转的数量和规模之大已使集体建设用地的流转发展成庞大而复杂的"隐性市场"。本文意在通过探究集体建设用地使用权的流转根源、流转中存在的问题,论证法律应放开集体建设用地使用权的流转,并针对问题进行制度规制方面的思考。
The circulation of the right of the rural collective-owned land for construction,being restricted legally,is so large in scale and quantity that it has developed into a big and complex invisible market.The paper is to discuss that the circulation of the right of collective-owned land for construction should be allowed legally and to put forward several thinking on system regulation on the basis of analyzing the reasons of circulation of the collective-owned land for construction,existing problems in the circulation.
