Remarks on Functions of Restorative Execution’s Crime Control

犯罪与被害之间的密切关系使得关注被害人成为控制犯罪的重要途径。而恢复性司法这一缘起功能成为恢复性行刑具备犯罪控制功能的内在原因。恢复性行刑不但能使施控者与一般社会主体在与被控者互动交流中淡化犯罪标签作用,还可实现管理信息与反馈信息在施控者与被控者之间的双向交流,提高司法控制功能。开放性的恢复性行刑模式通过培育服刑人员的"羞耻感"与利用"熟人社区"实现了对服刑人员的内外控制目的,大大增强了犯罪的社会控制功能。

The close relationship between the crime and the victimization makes it important to notice the victims for the sake of controlling the crimes.Restorative justice（the original function）has become the internal causes for the restorative execution to have the function of crime control.Restorative execution can eliminate the labeling effects in the interaction between the managers,the general people and the accused.Moreover,it can make the management information and the feedback information inter-communicate between the managers and the accused which will improve the judicial crime control function.The open restorative execution mode make the internal and outside control of the inmates come true.And for achieving the aim,the restorative execution mode make the full use of educating the shame feelings of the inmates and the force of ＂the acquaintance community＂ which greatly enhance function of crime social control.
