农民工“无奈之恶”的罪与罚——从犯罪互动看法官审判弱者的刑罚立场

Peasant Workers "Helpless Evil" in Crime and Punishment——a judge' s standpoint of penalty on the weak from criminal interaction

近年来,城市中的农民工频频以犯罪人身份出现在报纸传媒。其中,农民工因贫穷而努力求生存过程中实施的"无奈之恶"类案件,改变了社会对罪犯的同情必然少于对受害人的同情的思维定式,舆论倾向于更多地同情实施"无奈之恶"的农民工被告人。通过犯罪互动理论分析该类案件的加害—被害关系,探索法官审理该类案件时实现中立和公允的法律途径,在法意与民意之间取得衡平。

In recent years,the peasant workers in cities frequent crime appeared in newspapers and other media.Some of poor peasant workers might commit a crime like ＂ helpless evil ＂ when they are struggling for survival,which has changed general social thinking.Then social sympathy for victims becomes less than for criminals,Social public opinion tend to give more sympathy for peasant workers＇ ＂helpless evil＂.This thesis use theoretical analysis of criminal interaction on offender and victim,and explore neutral and fair legal means for judge to balance law intent and public opinion.
