On the Origin of Economic Law System Selection

经济关系主体对经济法的选择,强调的不是事后能否给予公正的裁判,而是事前是否进行了社会成本节约的共同预防。借助经济共同体概念的提出,发觉经济法蕴含着"经济共同契约"(自然法)精神,这种精神使经济法专注于经济集体浪费或者自我消耗之预防,并通过保护特定经济关系引导公众行为、行政执法和司法裁判,协同解决当前社会所面临的特殊经济困难或问题。

The selection of economic law made by the subject of economic relations is focused on whether there is common defence of ＂social cost＂ saving in advance, instead of on the subsequent fair judgment. With the concept of ＂the Economic Community＂, we note that economic law contains spirit of ＂common economic contract ＂（Natural Law）, which impels ecocomic law to focus on preventing self-consumption or waste of ＂social cost＂ and guide public acts, administrative law enforcement and the administration of justice by protecting special economic relations, and contribute to solving special economic difficulties or problems in our era.
