我国西部地区地方性外资法的困境与超越——基于路径依赖视角的考察

西部地方性外资法中的路径依赖现象颇为突出,其立法模式、内容和立法技术等被锁定在一定范围内,内化成西部地区的地方性外资法根深蒂固的特性,超越路径依赖需要制度创新,根本路径在于清理、整合和修改现有法规体系、规范授权立法、提高立法技术和完善立法内容,还应该注重法律的执行力度。

Path Dependence is very outstanding in the law of west regional foreign investment.The west regional foreign investment law was only locked on encouraging and attracting,and come into being the inner character of these laws.The basic way to solve the problem was unifying the main body of lawmaker,perfecting the legislative technique and distributing the power between the regional government and legislature.Furthermore,the enforcement of law is also important.
