近代驻外使节的法文化观——以张荫桓《三洲日记》为视角

Cultural Point of View of Law of the Ambassadors Abroad in Modern Times:A Case Study of Sanzhou Riji by Zhang Yinhuan

清臣张荫桓的事迹虽不广为人知,但他作为清季外交的实践者与戊戌变法的幕后人物,其作用和影响不容忽视。张氏驻外期间所撰《三洲日记》,其中种种"中眼观西"的见闻与体会深刻反映出他身处西方法律文化氛围,而心受中国传统法律文化熏陶的自我心态与认知匮乏。《三洲日记》中对中西法律文化的认知与比较是中西法律文化冲突在国人,特若近代驻外使节身上的浓缩和体现,其所蕴含的法律文化观亦为近代中国法律转型之彰显。

Zhang Yinhuan,minister in Qing Dynasty,was the practitioner of international relationship in Qing Dynasty and the wire puller in Wuxu bianfa.So his role was remarkable.His Sanzhou Diary shows how much he was influenced by the western law and eultural environment and also his poor perceptive power under the influence of the traditional Chinese law culture.
