Study on the Principle of the Invisible Tort in College Education:in the Perspective of the Comparative Law

对比显性侵权,高校隐性侵权因其内隐性、滞后性、不确定性等特征而不易被觉察,但其危害却是巨大的。针对我国高校隐性侵权现状,通过对中国与美国高校大学生权利保障之比较研究,探讨我国大学隐性侵权的归责原则,并提出积极预防高校隐性侵权、寻求权利救济的有效途径。

In college education,people give more concern on visible tort on campus than the hidden tort that is invisible,intangible and implicit,which is of enormous damage to college students.As for lots of invisible tort incidents in Chinese colleges,through contrasting the guarantee system of rights between US and Chinese college undergraduates,the essay analyzes the legal liabilities of college,and puts forward suggestion on the effective way of guarding against invisible tort and seeking for right relief.
