失地农民社会保障法律问题及对策研究

On Protection of Land-Expropriated Farmers' Rights and Interests

失地农民作为一个新出现的社会困难群体,在其失去土地之后,各种社会权益都不同程度地受到了侵害,存在权利缺损的现象。本文通过分析失地农民权益法律保护的正当性,结合我国目前保障失地农民法律保护的制度设计缺陷,提出了改革现有土地产权制度、完善土地征用法律规范、建立健全农村社会保障体系等相关对策。

Some of farmers' rights are being violated when they are deprived of their lands and reduced to a new marginalized social stratum. This paper argues for the legitimacy of protecting these land-expropriated farmers' interests. And considering existing discrepancies in legislation and practice in this aspect, the paper proposes approaches to amending the current mechanisms regarding land ownership and acquisition, for the end of constructing a sound social security system.
