Conservative Application of the Constitution

宪法能否在法院如同其他法律一样得到适用,一直以来成为法学界不断争论的焦点。从中国现实出发,在宪法适用的问题上应该遵循一个标准:原则上不适用宪法,特定情况下应该适用。此处的特定情况是指只有在出现宪法案例,且符合宪法判断回避原则的时候,应该适用宪法,即宪法的保守适用。

Whether or not the Constitution should be applied generally as other law has been a controversial point in the field of law. From the perspective of the reality in China, we should follow a standard about application of Constitution. That is to say, the prohibition use of Constitution in principle could be use in particular case. This parti- cular case refers to constitutional case. And what＇s more, this case should accord with the principle of avoiding using Constitution. That is the conservative application of the Constitution.
