风险社会背景下司法能动的正当性及其限度

The Limits and Legitimacy of the Judicial Activism in the Risk Society

风险社会的来临对法律的发展提出了挑战,也为司法能动提供了空间。风险的不确定性放大了法律的缺陷、风险发生时社会纠纷的激增以及风险社会对常态社会的诸多逆反等都为司法能动提供了正当性基础。尽管如此,风险社会中司法能动仍有一些限度和界限。风险发生时司法能动的预防功能有所减弱,同时司法能动在风险责任认定上也存在一定缺陷。风险社会的司法能动必须遵循司法的本质和规律,只有这样才能最终实现社会的公正。

The advent of risk society challenges the development of law,and also provides space for the judicial activism.It is the uncertainty of risk that blows up the legal defects,the proliferation of social disputes under the condition of risk occurs,and some risk society overturns the normal society,which justify the judicial activism.Although there are some limits and boundaries of judicial activism in risk society,the preventative function of judicial activism will be weakened and defects of the judicial activism exist during the course of determining risk responsibilities.Judicial activism must obey its nature and law,and it is the only way to ultimately achieve social justice.
