论我国教育法律的完善

On the Improvement of Our Educational Laws

教育法律是教育法治的前提和基础,但我国的教育法律仍有诸多不完善的地方。而教育法律的完善是一项全局而系统性的工作,总结与反思过去三十余年我国教育立法的经验与不足,教育法律的完善应当处理好如下几个问题,即:增强教育法律用语的确定性;教育法律权利不仅要实体赋权,更要程序保障;明确教育法律责任的归属、设定与追究;在保证教育法律稳定性的同时,不压抑教育法律"求变"的本性等等。

Educational law is the prerequisite and basis for the rule of educational law,but there is still a lot of imperfections in the country＇s educational law.However,the improvement of the education law is a global and systematic work,and summary and reflective the experience and defect of the educational legislation more than in the past thirty years,there are four questions needed to deal with in the future： enhance the law language＇s determinism;educational law rights should not only be affirmed by substantive law,but also be insured by legal procedure;clear educational legal responsibilities＇ affirmations,set and investigation;ensure educational law＇s stability and not oppress its nature pursuit for change,etc.
