摘要
政府对房地产市场的宏观调控是政府提供的一项"公共物品",是政府各种行政权力运行的结果,合法性是政府房地产调控行为的本质属性;在政府对房地产市场进行调控的过程中,应将政府的权力范围限定在一定的界限内,调控行为不能违背市场经济规律,不能侵害市场主体的合法权益;而目前调控行为中的"房产税"、"限购令"等措施在合法性、合理性方面都存在问题。
The government regulating and controlling the real estate market was a "public goods" provided by the government and a result of all kinds of administrative authority operation.The validity was the essential attribute for government's behavior of regulating and controlling the real estate market,in the process of which,it should define the government's authority in a certain boundary,the behavior couldn't violate the market economy law and couldn't infringe on the legitimate rights of the main market players.While the present behavior of regulating and controlling such as "the property tax" and "restriction command" had some problems in the validity and rationality.
