贵阳市地方环保立法的特色与完善

The Specialty and Improvement of the Legislation of Guiyang Local Environmental Protection

考察贵阳市环境保护立法后,认为该市地方环保立法具有较多的地方特色,建有生态城市法规体系,但也存在立法指导思想不明确、责任机制不健全、公众参与缺乏保障等问题。针对所存在的问题,提出明确环保优先原则、强化环保程序立法、尝试地区联动立法等建议,以期对全国的地方环保立法提供参考。

On the basis of the research for the legislation of Guiyang local environmental protection,the present paper points out that Guiyang＇s legislation is characteristic and Guiyang has built its＇ eco-city legislative system.Accordingly,there exists some problems,for example,the legislative guidelines are ambiguous,the mechanism of responsibility is not perfect,and the participation of public is not ensured,etc.Finally,the paper gives some suggestions to eco-city legislation in Guiyang such as the establishment of the principle of environmental protection priority,strengthening of the environmental protection procedure legislation,and the try-out of joint legislation between Guiyang and other cities in China.
