摘要 《铁路运营食品安全管理办法》于2010年9月8日由卫生部颁布实施。这是我国铁路系统关于食品安全管理的一部全新法规,它明确了铁路食品安全监督机构实施统一综合监督的执法主体地位,规定了铁路运营食品经营活动的地域和范围,提出了建立铁路运营食品安全监督协调机制。它是《中华人民共和国食品安全法》的一部配套法规,汇集了铁路内外众多专家学者的智慧,在广泛征求全铁路卫生监督机构意见的基础上完成,引入了食品安全管理的诸多崭新理念,为我国铁路食品安全监管提供了有力的法律依据。作者指出,虽然这部法规有许多新的亮点,但因我国铁路运营领域食品安全管理的特殊性和复杂性,该办法仍存有一些不足和欠缺,需要在监管实践中不断加以完善。 Railway operating food safety management measures was promulgated on September 8,2010 by the Ministry of Health.It is a new regulation about food safety management of railway system in our country.It cleared the law enforcement dominant position of railway food safety supervision institution,formulated the region and range of railway food services and proposed the establishment of railway food safety supervision and coordination mechanisms.It is a complementary law and regulation for Food Safety Law of the People's Republic of China,bringing together the wisdom of many experts and scholars inside and outside,bringing many new conceptions of food safety management,providing strong legal basis for railway food safety supervision.This legislation has many new highlights,but because of the specificity and complexity of railway food safety management in our country,there are also many shortages and defects,which needs to continuously improve the regulations in supervision practice.
