On the Analytic Theory of Governmental Interest and Its New Development

＂政府利益分析说＂曾经给国际私法产生了巨大的影响,但由于该理论的广泛适用将不可避免的导致法院地法的滥用,所以慢慢的走向了衰落。正是因为这些缺陷的存在,有些学者就从时代发展的角度,在汲取＂政府利益分析说＂精华的基础上提出了＂共同利益分析说＂。该理论以人类共同利益为出发点来解决国际交往中的法律冲突问题。这就适应了当今人类社会追求共同利益的需求,从而使该理论具有了强大的生命力。

The Analytic Theory of Governmental Interest once exerted a great influence on private international law.Yet,the analytic theory is gradually on the wane because of the broad application of the theory that would inevitably lead to the abuse of law of the local court.Because there are such drawbacks in the theory,some scholars,starting from the perspective of epoch development,put forward the analytic theory of common interest based upon the essence of the governmental interest analytic theory.The analytic theory of common interest is used to resolve the legal conflicts in international exchanges with the common interest of human as its threshold,which meets the contemporary human society＇s demand for common interest and hence brings itself great vitality.
