论司法良知

On Judicial Conscience

在法治社会,司法公正被公认为是保障社会正义的最后一道防线,而作为守护者的司法工作人员能否恪守司法良知则成为实现社会公平正义的关键。对司法良知进行历史考察和社会功能考察发现,我国司法良知的建设困难重重,面对司法腐败、司法不独立和市场经济负效应的侵蚀,塑造中国特色司法良知必须加强司法廉政建设、确立真正的司法独立制度、践行社会主义法治理念,以实际行动做到代表人民群众的利益,维护社会公平正义。

In the society of legal civilization, the judicial justice is recognized as the last defense line to real- ize social justice, but the key is whether the judicial staff can follow the judicial conscience. Studying the historical and the social function of judicial conscience, we find that there are great difficulties in domestic judicial conscience construction. In respect to the judicial corruptions, judicial non-independence and the negative effect of market economy, we should fight against judicial corruptions, establish true judicial independence and form the idea of ruling by law. Only by doing so can we safeguard people＇s interests and maintain social justice.
