摘要
错误的鉴定结论成为近三十年来发生的不少错案的直接原因。对这些由司法鉴定产生的刑事错案的共性问题进行分析,可以看出权力的介入对司法鉴定产生了某些影响,致使错误侦查、裁判与司法鉴定之间存在某些规律性的东西。文章认为,对我国司法鉴定中出现这些情况的解决思路,既要立足现实又要适度超前。
Wrong judicial appraisal is the direct reason for many erroneous criminal cases in the late 30 years.Based on the common problems in the cases,it is found that power interfere affects judicial appraisal and lead to biased investigation.The solutions should be designed a head based on the current situation.
