Boundary of school's safety assurance obligations to students in school sports activities

2009年颁布的《中华人民共和国侵权责任法》明确了学校应对学生承担"教育、管理"的安全保障义务。分析认为,学校承担相应义务的基础是安全保障,而非监护。学校在学校体育活动中对学生安全保障义务的确定实际上是一个风险、责任分配的过程,同时也是一个平衡协调的过程,即确定在学校体育活动中对学生的安全保障义务,在学校和家庭之间分配由学校体育活动所产生的风险,这个过程要有助于学校教学管理水平和学校体育的提高。

Tort Liability Law of the People＇s Republic of China issued in 2009 has defined the school＇s safety assurance obligations as ＂education and management＂.In this paper,the author holds that the school＇s safety assurance obligations focus more on safety than on guardianship.School＇s safety assurance obligations should define the school＇s liabilities and the risks taken by the family and the school.The process of the defining can help promote the school teaching management and sports.
