摘要
赔偿与刑罚关系在实践中呈现出各种不同的样态以及总体上赔偿对定罪量刑影响作用的提高,彰显出对赔偿与刑罚关系应然模式研究和设计的必要性。赔偿的作用不能过于夸大,也不能切断赔偿与刑罚的关系。赔偿与刑罚关系的安排,要兼顾多方价值追求,同时要具备可行性。
The relationship between restitution and punishment takes on different forms in legal practice.On the whole,the influence of restitution on the ruling of punishment has been increasing,suggesting the necessity to study and design the pattern of the relationship of restitution and punishment.It is important that the role of restitution should not be exaggerated on the one hand and the relation between restitution and punishment should not be severed on the other hand.Arrangements of the relationship between restitution and punishment should take into consideration the concerns of different parties and aim at feasibility.
