摘要
《铁路运营食品安全管理办法》是我国铁路系统食品安全管理的一部全新法规,它明确了铁路食品安全监督机构实施统一综合监督的执法主体地位,规定了铁路运营食品经营活动的地域和范围,提出了建立铁路运营食品安全监督协调机制。它是《中华人民共和国食品安全法》的配套法规,引入了食品安全管理的诸多崭新理念,为我国铁路食品安全监管提供了有力的法律依据,这部法规有许多新的亮点,但因我国铁路运营领域食品安全管理的特殊性和复杂性,该办法仍存有一些不足和欠缺,需要在监管实践中不断加以完善。
Railway operating food safety management measures was promulgated on September 8, 2010 by the Ministry of Health. It is a new regulation about food safety management of railway system in our country. It cleared the law enforcement dominant position of railway food safety supervision institution consolidated supervision enforcement, formulated the region and range of railway operating food activities and proposed the establishment of railway operating food safety supervision and coordination. It is a complementary law and regulations for Food Safety Law of the People's Republic of China, bringing together the wisdom of many experts and scholars inside and outside, having accompished it on the basic of soliciting opinions from all health inspection agencies, bringing many new conception of food safety management, providing strong legal basis for railway food safety supervision. This legislation has many new bright spots, but because specificity and complexity of railway operating food safety management field in our country, there are also many shortages and defects, needing continuously improve the regulations in supervsion practice.
