判例研究中新的视角及方法探求

Probe on the New Perspectives and Approaches on Precedents Study

引起广泛关注的"同案不同判"现象以及司法实务中法律统一解释适用方面存在的其他问题,都反映了必须加强判例研究并在方法上力求创新的时代要求。当前的相关研究中除了"制度构建"的思路外,还存在一种有新意的重要思路,即"从司法实务中发现或提炼判例"的研究路径。今后的判例研究应当整合这两种研究路径,使对于判例的研究本身成为有中国特色的判例制度建构过程之有机的一个部分。

The phenomenon of same case has different judgments,which aroused wide concern,and the other problems existing at the juridical practice for the unified judicial interpretation for the laws,all require the enhancement the precedents study and pursue innovation at the research approaches and to keep up with the times.Apart form the perspective of construction of system,there is another very new and important perspective,which is the research approach of finding and extracting precedent from the juridical practice.Henceforth,it necessary to combine those two kings of research approaches and making the precedents study to be an integral component at the process of construction of precedent system with Chinese characteristics.
