未成年犯缓刑适用的完善——刑法二元机能观视野下

Improving the Probation for Juvenile Offenders——From the Dualistic Function View of Criminal Law

刑法二元机能观决定了未成年犯"保障机能优先,兼顾保护机能"的缓刑适用原则。在这一视野下,我国未成年缓刑适用运行机制存在立法不完善、调查制度未建立、司法适用不平衡、缓刑监管机制不健全等方面不足,需要进一步放宽缓刑的适用对象、细化缓刑适用情节、规范缓刑适用调查制度、健全未成年犯的监管来完善未成年犯缓刑适用,以此实现未成年犯权益保护和打击犯罪两者的有机统一。

The dualistic function view of Criminal Law decides that juvenile offenders should be applied the probation principle that guarantee function is the first,and simultaneous attention should be given to protection function.In this view,our probation operation mechanism for juvenile offenders has such shortages as imperfect legislature,unfounded survey system,unbalanced judicial application,defective probation monitoring mechanism and so on.Therefore,to harmonize juvenile offenders＇ rights protection and fighting criminals,this paper suggests that loosening applicable objects,elaborating applied circumstance,regulating research system and perfecting supervision should be taken to improve probation application.
