秩序——刑罚的伦理价值目标

Order:The Goal of Ethical Value Embodied in Penalty

人类的生存和发展离不开秩序,人类的文明进程也就是对秩序的追求过程。从伦理价值目标的主体需要性、至善性和刑罚的惩罚本质属性看,刑罚的伦理价值目标为体现个体自由和社会正义的社会秩序。这样的秩序是人类在长期的社会实践中自由选择的结果,是人类发展的需要。国家在实施制刑权、量刑权、行刑权时应该以这一目标为宗旨,不断实现公民自由,充分体现社会正义,维护和谐的社会秩序。

Human survival and development require order,and the process of human civilization is a process of pursuing order.From the perspective of the subjectivity of ethical goal,virtue orientation and the nature of penalty,the ethical goal of penalty aims to realize individual value and social order.Such order is the result of free choice by humans in their long social practice and a must for human development.The government should abide by this goal in the implementation of penalty rights,try to realize justice and freedom for all citizens and maintain a harmonious social order.
