摘要
交通运输部明确规定自2010年11月1日起,无船承运人可选择保证金责任保险方式申请取得无船承运业务经营资格,这标志着我国无船承运人以交存保证金作为唯一财务责任担保方式的终结。本文将前后两种制度加以介绍比较,认为新制度虽有亮点但也需进一步完善。
On Sep.28,2010, Ministry of Transport enacted a notice, which explicitly stipulates that NVOCC can choose the way of covering security deposit responsibility insurance in order to apply for the qualification of NVOCC from Nov.1,2010. This marks the ending of security deposit as the only way of financial responsibility warranty of NVOCC. This essay introduces and compares the two systems, and indicates that though the new system has its own merits, it also needs to be improved.
