摘要
通过移植方式进入中国的立法听证制度与我国所实行的人民代表大会制度和中国共产党领导的多党合作政治协商制度不相适应,结合我国的国情,可以通过完善人大代表的选举制度、明确党与人大之间的关系等方式来促进立法的民主化和科学化,而非盲目地在立法过程中引入听证制度。
Legislative hearing system entering into China with transplantation method doesn＇t fit China＇s NPC System and Multi-Party Cooperation and Political Consultation System under the leadership of the CPC.To promote democratic and scientific legislation,we should perfect the electoral system of the delegates to the people＇s congress of China and definite the relation between the party and the NPC combining the national conditions,but not blindly introduce hearing system during the legislation.
