共同过失犯罪作为共同犯罪问题中最有争议的部分之一,围绕这一问题存在有诸多学说。其中日本刑法学界的研究最为深入,其研究成果对我们有着深刻的借鉴意义。我们应在比较中加以吸取,以更好地完善我国共同犯罪的立法及司法。

As one of the most controversial parts of joint offense,there are different theories on offense of joint negligence.Among them,Japan has done a most in-depth research in criminal law,which has profound significance for our reference.We should learn from it in the comparison to better improve our legislation and justice on offense of joint negligence.
