跨国公司知识产权滥用的反垄断规制——以《反垄断法》为视角

Antimonopoly regulating to misusing IP right of Transnational Corporations——At the angle of Antimonopoly Law

从反垄断法的视角看,跨国公司滥用知识产权的行为具体表现在滥用市场支配地位、通过许可协议限制竞争、通过企业合并限制竞争以及滥用诉权等。而我国《反垄断法》对跨国公司知识产权滥用行为的规制还有许多不完善之处。因此,进一步制定知识产权滥用的反垄断细则,规定知识产权反垄断机构,以及明确反垄断的域外适用等问题是我国反垄断法需要解决的问题。

From the angle of antimonopoly law,the misusing of IP right of transnational corporations involves lots of methods,such as abuse of control of market,limitation to competition by licensing agreement,limitation to competition by enterprise merge,abuse of action right,and so on.There are lots of aspects which need to be perfected about our country＇s Antimonopoly Law.Therefore,making of detailed rules,regulating of special antimonopoly agency,clarifying of extraterritorial application of Antimonopoly Law are the key issues which will be settled by our country＇s Antimonopoly Law.
