整体犯罪构成是指两人以上的共同行为所符合的犯罪构成。不管是否采纳修正的犯罪构成概念,整体犯罪构成都是认定共同犯罪的基础;整体犯罪构成要和共犯的成立条件相区分,作为整体犯罪构成评价对象的事实行为要结合单独犯罪来确立;在共同犯罪中,只要有利用身份的情况出现,就可以认为构成相应的身份犯,如果同时满足非身份犯的犯罪构成,就形成了非常特殊的想象竞合关系。
