当前职务犯罪侦查工作机制存在的问题及对策——以芜湖市基层院为视角

Problems in the Investigation Mechanism on Duty Crimes and Countermeasures——Taking the Basic-level Procuratorate in Wuhu as an Angle

当前,我国职务犯罪侦查工作机制还存在着职务犯罪案件线索来源渠道不宽、信息不畅,职务犯罪案件线索管理及侦查管辖属地化、抗干扰能力不强,初查手段立法规定位阶低、较为单一,职务犯罪侦查资源分散、力量不集中,拘传12小时时限的过短,职务犯罪侦查法定手段不力,尤其是不能使用特殊侦查手段等问题。针对上述问题,应采取相应的对策,以推进职务犯罪侦查工作的深入开展。

At present, there exist many problems in the investigation mechanism on duty crimes in China, such as limited sources for information and clues about duty crimes, the localization of the management of clues about duty crimes and investigation on them and the lack of anti-interference ability of investigation department because of this, low hierarchy of legal regulation on preliminary investigation method and single investigation method, dispersed investigation resources, the short time limitation for summons for detention, which is just 12 hours, the ineffective investigation method permitted by law, especially the lack of special method in the investigation, etc. In light of the problems above, the author advances certain countermeasures to go deep into the implementation of investigation on duty crimes.
