摘要
在我国,房屋承租人优先购买权的权利性质经历了由"物权阶段"向"性质待定阶段"再向"债权新阶段"转变的过程。最高人民法院出台了新的司法解释,第一次明确提出债权性质的房屋承租人优先购买权。研究这一转变过程,对于确立房屋承租人优先购买权制度的价值基础和完善该制度体系具有重要意义。
In China, the nature of lessees' preemptive right has changed from the the stage of "property right" to the stage of "undetermined nature" and then to "obligatory right". Recently the Supreme People's Court issued a new judicial interpretation, regarding the preemptive right as a kind of obligatory right. Studying on the transition has significance in establishing the value basis of the system of lessees' preemptive right and optimizing the system.
