我国法律援助制度发展的新境界——和谐社会法律援助制度的理论基础

The New Realm of the Development of China’s Legal Aid System——The Theoretical Basis of Legal Aid System in a Harmonious Society

对我国法律援助制度的探讨,不应仅停留于具体的制度层面,而应上升到理论基础的高度。目前学界对法律援助制度理论进行基础性、前沿性、创新性研究较少,未能充分发挥理论的先导作用。为此,本文试图从价值基点、经济基石、政治基源、人文基础等方面对和谐社会法律援助制度的理论基础进行探讨。

The author thinks that we should not only explore the legal aid system in China in the aspect of specific system,but should explore it on a theoretical basis.At present there are few fundamental,pioneering and innovative studies on the theory of legal aid system in academic circle.The leading function of the theory has not been fully displayed.In this case,the author tries to explore the theoretical basis of legal aid system in a harmonious society in such respects as the basis of value,economy,politics and humanity.
