摘要
随着监狱学说的发展和刑罚目的的逐步转变,囚犯同居权应有其存在的空间。设立囚犯同居权有着现实意义和法律价值。要充分认识到确立囚犯同居权在实践中可能遇到的各种问题,在制度设计时应从实体和程序两个方面着手。
With the development of penology and the change of the purposes of legal penalty, we should consider enacting law to protect prisoners＇ conjugal right, which has practical meanings and legal value. We should fully consider the various problems we may meet in the practice and should start from the aspects of entity and procedure in the institutional design.
