论法官司法良知的制度保障

On the Institutionally Safeguarding of the Judicial Conscience

"徒善不足以为政,徒法不足以自行",法律需要有一批精通法律、有良好职业道德的法律人去实施。在我国目前成文法的框架下,法律相对于判例法国家来说,其内容更加具有普遍性和一般性。对法官的司法良知予以制度保障,可以更好地发挥法官的自由裁量权,真正实现法律的公平和正义。本文从我国目前法学教育中存在的问题,法官制度中存在的问题,司法运行中存在的一些问题,分析了法官司法良知的重要性,提出了从制度上保障法官司法良知的几点建议。

＂Only virtue is insufficient to go into politics;Only law is not enough to be implemented by itself＂.The law needs to be implemented by a group of good lawyers who have professional ethics.Currently,under the framework of the statute law in our country,the content of the law is more universal and general relative to the case-law countries.How to safeguard the judges＇ judicial conscience is essential to play their own discretion and truly achieve equity and justice of the law.At the angle of the questions which exist in the legal science education of our country at present,the questions which exist in the justice system and some questions which exist in the judicial operation,this article has analyzed the importance of the judicial conscience of the judges and put forward several suggestions to safeguard judges＇ judicial conscience institutionally.
