列宁检察监督思想下的中国检察监督制度——以历史演进为视角

Procuratorial and Supervision System of China Influenced by Lenin's Thinking of Procuratorate and Supervision

中国的检察监督制度与列宁的检察监督思想虽具有明显的逻辑联系,不少技术性规定甚至有照搬之嫌,但这种联系并非一成不变,而是随着中国检察监督制度的演变而发生了微妙变化。在新时代下,列宁的检察监督思想处于欧美经验及本土生成的双重夹击中,一些难以克服的缺陷正阻碍中国法律制度尤其是刑事司法制度的良性运作。故从历史演进的角度看,列宁的检察监督思想可视为特定政治、历史背景下所形成的一种"传统",而不宜视为"正统",更不宜通过政治话语获得永久性的垄断地位。

Obviously there is a logic link between Lenin＇s thinking of procuratorate and supervision and the procuratorial and supervision system of China which gradually changes with the development of these systems.In new times,the insuperable defects of Lenin＇s thinking of procuratorate and supervision become an obstacle to the legal system and the criminal justice system of China.Taken from the point of view of historical evolution,Lenin＇s thinking of procuratorate and supervision can be regarded as a tradition in certain political and historical background but not an orthodox which can achieve permanent monopoly position through political dialogues.
