试论我国少数民族受教育权法律保护制度的完善和发展

On Perfection and Development of Legal Protection System of Minorities' Right to Education

随着社会主义法律体系的初步形成,我国少数民族受教育权法律保护制度也完成了基本的构架过程,然而也暴露出种种缺憾。要对其加以完善,首先必须促成相关法律意识的进化,尤其需对不同意识主体的不同情况进行针对性分析。其次,应分别从宪法、法律、行政法规和地方性立法四个层面对法律制度的完善进行思考。最后,根据当前客观实际对这一法律制度的发展趋势进行科学的预测,以此为未来的相关工作方向提供理性指导。

With the initial establishment of socialism legal system,legal protection system of minorities＇ right to education has also been developed basically,but it reveals some problems inevitably.In order to perfect it,it is important to advance correlative legal consciousness,especially give the pertinency analysis to different conscious subjects.Then,it is necessary to think over this issue from four aspects——constitution,law,administrative regulations and local legislation.At last,according to the current situation,it is better to make scientific prediction for the developing tendency of the system so as to provide rational guidances for the future relative work.
